Denmark: An Overview of Radio Equipment and Electromagnetic Conditions, Order No. 1710/2023

Order No. 1710/2023, adopted by the Danish Ministry of Energy, Utilities and Climate Change on 12 December 2023, lays down rules for the conformity assessment of radio equipment. Furthermore, the Order transposes Directive (EU) 2022/2380 on a common charger into Danish Law. The Order repeals Order No. 1107/2019.

Rules for the Conformity Assessment of Radio Equipment

The Order addresses manufacturers of radio equipment and entails specifications on testing, labeling, technical documentation, conformity assessment and competencies of the notified body. It does not apply to apparatus, fixed installations and radio equipment listed in Annex 1 (marine and aviation equipment and equipment intended to be used by radio amateurs). Appliances that are in compliance with the European Harmonized Standards are deemed to be compliant with this Order.

Based on Article 4, manufacturers must either use the internal procedure set out in Annex 2 or the EU-type examination followed by conformity to type based on internal production control as described in Annex 3 for their conformity assessment. The EU declaration of conformity must be drawn up in accordance with Annex 4 and shall state that the equipment complies with all essential requirements. The manufacturer must affix the CE marking (specifications in Annex 11) in an indelible and legible way. Article 9 sets out the maximum permissible radiation for the use of fixed electronic communication networks.

Common European Charger

Article 10 sets further specific design requirements for radio equipment, transposing the requirement for a common European charger as introduced under Directive (EU) 2022/2380 into Danish Law. The radio equipment listed in Article 11 (2) must be equipped with USB type C connectors as described in the standard set out in section 2.1 of Annex Ia, Part I to Directive 2014/53/EU (as amended by Directive (EU) 2022/2380).

This requirement applies to handheld mobile phones, tablets, digital cameras, headphones, headphones with microphone, handheld video game consoles, portable speakers, e-book readers, keyboards, mice, portable navigation systems, earbuds and laptops.
