Introduction

On 3 April 2024, Finland’s Ministry of Transport and Communications published Decree 152/2024 on the conformity of radio equipment.

In this blog, we examine the requirements for radio equipment under Decree 152/2024.

Requirements

§ 1 states that categories of radio equipment defined in Article 44 and Article 3(3) of Directive 2014/53/EU must meet the following essential requirements:

  • Radio devices must work together with additional devices, especially universal chargers;
  • Radio devices must work together via networks with other radio devices;
  • Radio devices must be connectable to appropriate interfaces;
  • Radio devices must not damage the network or its operation and must not misuse network resources, thus causing an unreasonable deterioration of the service;
  • Radio devices must include security devices that guarantee the protection of the user’s and subscriber’s personal data and privacy;
  • Radio equipment must support anti-fraud features defined in Directive 2014/53/EU;
  • Radio equipment must support the features that guarantee access to emergency services defined in Directive 2014/53/EU;
  • Radio equipment must support features defined in the implementing directive, which make their use easy for the disabled; and
  • Radio equipment must support features defined in the implementing directive, which guarantee that software can be loaded into the radio equipment only if mutual conformity has been demonstrated.

Decree 152/2024 also stipulates that manufacturers of radio equipment must register in the European central system referred to in Article 5(4) of Directive 2014/53/EU. The fulfilment of essential requirements laid down in Section 251 of the Electronic Communications Services Act 917/2014 and Section 1 of Decree 152/2024 is mandatory before the equipment is placed on the market. Furthermore, manufacturers must affix the registration number assigned by the EU Commission to the registered radio equipment.

What’s Next for Decree 152/2024?

Decree 152/2024 will enter into force on 28 December 2024, whereupon the Conformity of Radio Equipment Decree 600/2016 will be repealed.
