Industrial Machinery Regulation

Industrial machinery regulation is showing no signs of slowing down. In this blog we discuss some of the most recent regulatory updates affecting the machinery world in Europe and beyond!

Switzerland

Switzerland has recently published an Ordinance for the designation of technical standards for machinery under the Product Safety Act and the Machinery Ordinance. The Ordinance aims to align with Decision (EU) 2024/2408 which establishes new harmonized standards for machinery drafted in support of Directive 2006/42/EC with regard to the following products:

  • Lifting tables (EN 1570-1:2024)
  • Earth-moving machinery (EN ISO 3164:2013/A1:2024)
  • Cranes (EN 13557:2024)
  • Power-operated pedestrian doorsets (EN 16005:2023+A1:2024)

Following the publication of the Ordinance, a consolidated list of designated technical standards relating to machinery was published on 29 October, see full list here.

UK

On 16 October 2024, the UK Department for Business & Trade published a proposal to amend the list of designated standards for machinery.

Similarly to Switzerland, this UK Notice aims to include the above-mentioned standards to the list. 

The publication of the final Notice is expected on 14 November 2024.

Vietnam

A draft Technical Regulation was issued by the Vietnam’s Ministry of Transport establishing safety and environmental protection requirements for construction machinery. The new QCVN 13:2024/BGTVT, which will repeal QCVN 13:2011/BGTVT, will regulate the technical safety and environmental protection quality of construction machinery as regards production, assembly, import and renovation.

Parties to be impacted by the regulatory obligations include manufacturing and assembling establishments, importers and owners of XMCD in use, along with organizations and individuals involved in the management, inspection, testing and certification of XMCD. 

The proposal sets out general requirements for both unused and used machinery. Machinery must be manufactured and assembled from completely new components, securely installed in accordance with the manufacturer’s design and technical documents, and operate stably under normal conditions. 

Specific requirements are set out for:

  • Engine and transmission system;
  • Steering system and control system;
  • Brake system;
  • Suspension system;
  • Fuel system;
  • Electrical system;
  • Lighting and signal system;
  • Speedometer;
  • Other gauges (if any): vehicle operating time, engine coolant temperature, air pressure or hydraulic oil pressure measurement.

A transition period is granted for machinery with a certificate issued under QCVN 13:2011/BGTVT which is still valid at the time of the entry into force of the new regulation.

EAEU

On 10 October 2024, the Eurasian Economic Commission issued Decision No. 116 to amend Decision No. 28, 2021 approving the list of voluntary standards the application of which may be used to demonstrate compliance with the requirements of the Technical Regulation on the Safety of Machinery and Equipment (TR CU 010/2011).

This Decision adds to the list UN Rules and interstate standards relating to requirements for equipment for powering an engine with gaseous fuel (compressed natural gas (CNG), liquefied natural gas (LNG), liquefied petroleum gas (LPG) and methods for their control.

The Decision will enter into force on 23 November 2024.
